Estate planning, probate, and trust law — prepared carefully for Malaysian families with complex circumstances.

How Each Matter Is Handled
Every matter handled at Pusaka Counsel follows the same structured approach, regardless of the service involved. It begins with an unhurried initial consultation — a meeting designed to understand the client's circumstances, not to recommend a service before hearing what is actually needed.
Following the consultation, a written summary of what was discussed, what is recommended, and what the fixed fee will be is provided to the client. Engagement begins only once that summary has been reviewed and accepted. Work does not begin on the basis of a verbal agreement.
Drafts are prepared in stages. Each stage is provided to the client for review before the next begins. Revisions are accommodated within the engagement fee. When the client confirms they are satisfied with the final document, arrangements for signing and registration are made.

Comprehensive Estate Plan Drafting
A careful, end-to-end estate planning service for clients with complex assets, multiple beneficiaries, or both. The work begins with a long, unhurried conversation about the client's wishes and family circumstances, followed by drafting of will, supporting trust arrangements where appropriate, and any associated directions.
Drafts are reviewed in stages so the client has time to consider each piece, and revisions are accommodated patiently before any signing is scheduled. This service is suited to clients who own a mix of property types, have beneficiaries in different locations, or have specific wishes about how particular assets should pass.
- Will and associated testamentary documents
- Trust arrangements where beneficial to the estate plan
- Letter of wishes for guidance to executors
- Staged draft review with revisions included
- Typical timeline: 4–8 weeks from instruction

Probate Administration with Foreign Assets
Administration of a probate matter where some of the deceased's assets are held outside Malaysia — overseas bank accounts, foreign property, or international investment holdings. The work involves careful coordination with foreign counsel, patient handling of cross-border timelines, and clear written updates to executors and beneficiaries.
Honest views are shared on how long these matters typically take, which is usually longer than families would wish. Executors are updated at each significant stage so that family members are not left uncertain about where a matter stands.
- Malaysian Grant of Probate application
- Liaison with foreign counsel in relevant jurisdictions
- Written updates to executors at each stage
- Asset repatriation coordination where required
- Timeline varies — typically 12–24 months for cross-border matters

Trust Establishment for Family Continuity
Establishment of a private trust to provide for family members across generations, drafted with attention to the family's specific circumstances rather than templated. The work covers conversation about the trust's purpose, drafting of the trust deed, and patient explanation of how the trust will operate in practice.
This service is suited for clients who wish to put thoughtful arrangements in place during their lifetime rather than leaving questions to be resolved later — particularly where there are minor children, a family member who may need ongoing support, or a wish to provide across more than one generation.
- Bespoke private trust deed
- Trustee guidance and written operational explanation
- Coordination with nominated trustees
- Registration under Trustee Act 1949 where applicable
- Typical timeline: 6–10 weeks from instruction
