How long does a standard will drafting engagement take? +

Most estate plan drafting engagements span four to eight weeks, depending on the complexity of assets and how many rounds of revision are needed. We work at a pace that allows clients to consider each draft carefully before we proceed.

What makes probate more complicated when foreign assets are involved? +

When a deceased person held assets in more than one country, each jurisdiction typically requires its own legal process. A Malaysian Grant of Probate may need to be resealed or re-applied for in the relevant foreign jurisdiction. Coordinating these processes takes time, and different countries move at different speeds.

Do I need a trust if I already have a will? +

Not always, but for some families a trust provides arrangements that a will cannot — particularly where there are minor children, a beneficiary who may need ongoing support, or a wish to provide across more than one generation. We can discuss whether a trust would serve your circumstances during an initial consultation.

What are your fees and how are they structured? +

Our fees are fixed for each service and shared clearly before any engagement begins. Estate plan drafting starts from RM 4,500, probate administration with foreign assets from RM 3,800, and trust establishment from RM 2,500. We do not bill by the hour for these services, so clients know what to expect.

How is client information handled? +

All matters handled by Pusaka Counsel are treated with the confidentiality required under Malaysian legal professional standards. Information shared during consultations or in the course of an engagement is not disclosed beyond what is necessary to carry out the work.

Can I begin the process before a family member passes away? +

Yes, and in most cases it is advisable to do so. Putting a will and trust arrangements in place during one's lifetime allows for proper consideration, revision, and planning. It also reduces the burden placed on family members at an already difficult time.
